1.Default rights model
In plain English
Unless otherwise specified in the campaign brief or a paid agreement:
- The creator retains ownership of their original content.
- The brand receives permission to repost approved content organically on its owned social channels, with attribution to the creator.
- Paid media usage, whitelisting, sublicensing, editing beyond minor cropping/captioning, broadcast, print, retail, packaging, or out-of-home usage requires separate written approval or upgraded usage terms.
- WITHINFEED may display approved campaign content within the platform, case studies, editorial recaps, sales materials, and promotional materials, unless restricted by written agreement.
2.Creator-generated content
“Content” means photos, videos, captions, audio, designs, and other creative materials you produce in connection with a campaign, brief, or bid. You represent that you own or have the rights to the content you submit, including rights to any music, footage, likenesses, locations, and third-party materials it contains, and that it does not infringe anyone’s rights.
3.Brand usage rights
Organic reposting
By default, brands may repost approved content organically on their owned social channels (such as their own feed, stories, and profiles) with creator attribution, for the duration agreed in the brief or, if unspecified, on an ongoing basis for owned-channel reposting.
Paid ad usage
Running content as paid advertising (boosting, paid social, programmatic, or other paid placements) is not included by default and requires separate written approval and, where applicable, upgraded usage terms and compensation.
Whitelisting / creator licensing
Running ads through the creator’s own handle (whitelisting, partnership ads, or spark/branded-content access) requires the creator’s explicit authorization and separate terms.
Out-of-scope usage
Broadcast, connected TV, print, retail, packaging, out-of-home, sublicensing to third parties, or use by brands other than the contracting brand each require separate written approval.
4.WITHINFEED platform & editorial usage
WITHINFEED may display approved campaign content and creator profiles within the platform and in case studies, editorial and community recaps, sales materials, and promotional materials, with attribution, to operate and promote the network — unless you or the brand restrict this in a written agreement. WITHINFEED’s editorial and community features may reference campaigns and creators as part of storytelling about the network.
5.Duration, exclusivity, and source files
Duration of rights
Usage duration is set by the brief or agreement. If not specified, organic owned-channel reposting rights are ongoing, while any expanded usage applies only for the period expressly granted.
Exclusivity
Engagements are non-exclusive unless the brief or agreement expressly grants exclusivity (for example, category or time-based exclusivity), which must be defined in writing and may require additional compensation.
Raw footage / source files
Delivery of raw footage, RAW photos, or project/source files is not included by default. Final approved deliverables are what is licensed unless the brief or agreement states otherwise.
6.Approval process and revisions
- Deliverables are subject to the review and approval steps described in the brief or bid (including the creator's 'mark delivered' step and the brand's final approval).
- A reasonable number of revisions may be included as specified in the brief; additional revisions beyond the agreed scope may require updated terms.
- Usage rights attach to approved deliverables. Use of unapproved drafts or out-of-scope materials is not licensed.
7.Attribution and FTC disclosure
Creator attribution
When a brand reposts creator content, it should provide reasonable attribution (such as tagging or crediting the creator), unless the parties agree otherwise.
FTC disclosure requirements
Creators and brands are responsible for clearly and conspicuously disclosing material connections in accordance with the FTC’s Endorsement Guides and applicable law. This includes sponsored, gifted, paid, and incentivized relationships — using clear disclosures (for example, #ad, #sponsored, or platform paid-partnership tools) placed where audiences will notice them.
8.Removal requests and disputes
If content is used outside the agreed scope, the affected party may submit a removal or correction request. Brands agree to promptly stop unauthorized uses and remove out-of-scope content on reasonable notice. WITHINFEED may assist in coordinating resolution but is not the arbiter of underlying agreements between a brand and a creator.
